REFUND & CANCELLATION POLICY

1. Product Returns and Exchanges (Merchandise)
Products purchased through the Gemmez store (uniforms, equipment, accessories) may be returned or exchanged under the following conditions:
- Items must be unused, unworn, and in their original condition.
- Return or exchange requests must be made within 14 days of purchase.
- Items must be returned directly to the coach at the end of a class or by prior arrangement with the academy.
- Refunds will be issued using the original method of payment once the item is inspected.
The following items are non-refundable:
- Gymnastique Québec affiliation fees (third-party federation requirement)
- Worn or used items
- Personalized or special-order items
- Hygiene-sensitive items such as toe shoes, leotards or socks once worn
2. Class Registration and Service Contracts
Registration in a Gemmez class constitutes a service contract for sports instruction. In accordance with the Consumer Protection Act of Québec, a participant may cancel their registration at any time by sending written notice to: admin@gemmez.com
3. Cancellation by the Consumer
If a consumer cancels their registration, the following rules apply:
- The consumer only pays for classes already provided at the agreed rate.
- The academy may retain a $25 administrative processing fee (non-refundable) to cover online transaction and administrative costs incurred.
- The academy may retain the lesser of: $50 or 10% of the value of the remaining classes not yet received, as permitted under the Québec Consumer Protection Act.
- Any amount already paid exceeding this calculation will be refunded to the consumer within a reasonable timeframe.
The following fees remain non-refundable once incurred:
- Gymnastique Québec affiliation fees (federation requirement)
- Uniforms, toe shoes, worn sportswear or used equipment
- Administrative processing fee ($25)
4. Missed Classes
Missed classes due to personal scheduling conflicts, illness, or other personal circumstances are non-refundable and cannot be transferred to another session. Each athlete's spot is reserved exclusively for them throughout the session - this guarantees the participant's place regardless of attendance.
5. Cancellation or Changes by the Academy
Gemmez Académie d'Excellence reserves the right to:
- Cancel a class or program due to insufficient registration.
- Modify schedules or class times based on registration levels or facility availability.
If the academy cancels a program before it begins, participants will receive a full refund.
6. Class Cancellation During the Season
If a class must be cancelled due to:
- coach illness or unavailability
- facility closure
- weather conditions
- power outages or other circumstances beyond the academy's control
the academy may, depending on facility availability:
- reschedule the class at a later date
- provide a replacement class
- or issue a credit applicable to a future session.

Please note that a make-up class may not always be possible due to limited facility availability. In such cases, the academy may, at its discretion, offer a partial credit toward a future session, proportional to the number of classes not delivered. |

7. Gymnastique Québec Affiliation Fees
Gymnastique Québec affiliation fees are mandatory for all participants and are managed directly by Gymnastique Québec, an independent sports federation. These fees are forwarded to the federation at the start of the session and are non-refundable, regardless of the number of classes the participant attended during the session.
